These Terms of Service (“Terms”) govern your access to and use of the House of Berber website at houseofberber.com (the “Site”), and any purchase of products from us. By using our Site or placing an order, you agree to these Terms in full.

1. Who We Are

House of Berber (“we”, “us”, “our”) is a Moroccan business specialising in authentic, hand-knotted Beni Ourain and Berber rugs sourced directly from cooperatives in the Atlas Mountains.

2. Eligibility

By using the Site or placing an order, you confirm that:

  • You are at least 18 years old, or the age of majority in your jurisdiction;
  • You have full legal capacity to enter into a binding contract;
  • The information you provide is accurate and complete;
  • You are using the Site for personal or business purposes, not to resell unless explicitly authorised by us in writing.

3. Account Registration

You can place an order as a guest or by creating an account. If you create an account:

  • You are responsible for keeping your password confidential;
  • You are responsible for all activity that occurs under your account;
  • You agree to notify us immediately of any unauthorised use;
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Our Products

4.1 Authenticity

Every rug we sell is hand-knotted by Berber women in Morocco’s Middle Atlas, using 100% Atlas Mountain wool. We do not sell machine-made rugs, blends, or imitations.

Each rug ships with a Certificate of Authenticity stating the cooperative of origin, the lead weaver, the region, the knot density, the wool composition, the estimated weaving hours, and the completion date.

4.2 Lifetime authenticity guarantee

If, at any time, you have a rug we sold you assessed by an independent expert and they conclude it is not authentic (the wool is blended, the rug is machine-made, or the provenance is false), we will refund 100% of the purchase price and arrange free return shipping. This guarantee never expires.

4.3 Product descriptions and images

We make reasonable efforts to display each rug accurately, including dimensions, knot density, colour, and wool composition. However:

  • Colour: hand-woven natural wool varies. Each rug is photographed under standardised lighting, but slight differences between the photos and the actual rug are normal and expected.
  • Dimensions: measured at the point of completion. Hand-knotted rugs may have natural variations of up to ±3% in either dimension.
  • Patterns: small irregularities are intentional and characteristic of authentic Berber craft.

If a rug differs significantly from its description, contact us within 14 days of delivery for resolution.

4.4 Availability

Most rugs are one-of-a-kind. Once sold, the same piece cannot be reproduced. We reserve the right to limit purchase quantities and to refuse or cancel orders at our discretion (with a full refund if payment has been taken).

5. Pricing and Payment

5.1 Pricing

  • All prices are displayed in US Dollars (USD) unless otherwise specified;
  • Prices include applicable VAT/sales tax for EU and UK customers (pre-paid by us);
  • For other regions, prices exclude any import duties, customs fees, or taxes that may apply on arrival in your country;
  • Prices and product availability are subject to change without notice;
  • In the rare event of a pricing error, we reserve the right to cancel the order with a full refund. We will notify you before processing the order.

5.2 Accepted payment methods

We accept payments via:

  • Credit and debit cards (Visa, Mastercard, American Express) processed by Stripe;
  • PayPal;
  • Bank transfer (for orders over $5,000, on request).

Payment is processed at the time of order. We do not store your full card details on our servers (see our Privacy Policy).

5.3 Fraud prevention

We screen all orders for potential fraud. Suspicious orders may be cancelled and refunded without notice. We may request additional verification before shipping high-value orders.

6. Shipping

6.1 Free worldwide shipping

We offer free worldwide shipping on every order. There are no hidden delivery fees.

6.2 Delivery times

All orders are dispatched within 48 hours of payment confirmation. We use DHL Express with full tracking and signature on delivery.

Delivery times are estimates and not guaranteed. Customs clearance delays are outside our control.

6.3 Customs duties and import taxes

  • EU & UK customers: all duties and VAT are pre-paid by us. The price you see is the price you pay.
  • US customers: orders under $800 are duty-free. For orders over $800, you may owe a small import duty (typically 0–3% on wool textiles). We disclose the estimate on your order confirmation.
  • Other regions: customs duties and taxes are the customer’s responsibility. Contact your local customs office for rates before ordering.

If a parcel is refused at customs and returned to us, refunds will be processed minus the actual return shipping cost.

6.4 Risk and title

Title to the rug passes to you upon delivery. Risk of loss or damage passes upon delivery to the carrier; however, all parcels are fully insured for the full purchase price. In the unlikely event of loss or damage in transit, we will replace the rug or refund in full.

7. Returns and Refunds

7.1 30-day return window

You may return any in-stock rug within 30 days of delivery for any reason.

7.2 Conditions for return

To be eligible for a return, the rug must be:

  • In its original condition (no stains, no signs of heavy use, no pet hair, no fragrances);
  • With its original tags, packaging, and Certificate of Authenticity;
  • Returned within 30 days of the delivery date.

7.3 Return process

  1. Email [email protected] with your order number and the reason for return;
  2. We will provide a return shipping label and instructions;
  3. Pack the rug carefully in its original packaging;
  4. Hand the parcel to the courier we arrange;
  5. Once we receive and inspect the rug, we will process your refund within 5 business days.

7.4 Return shipping

Return shipping is free for EU, UK, and US customers. For other regions, return shipping cost will be deducted from the refund.

7.5 Refund method

Refunds are issued to the original payment method. The refund typically appears in your account within 5 to 10 business days after processing, depending on your bank or card issuer.

7.6 Non-returnable items

  • Custom commissions (made-to-order rugs) are non-returnable, but covered by our quality guarantee (see Section 8).
  • Sale items may be subject to specific return restrictions, which will be clearly indicated on the product page.
  • Rugs returned damaged, stained, or in unsellable condition will be refused, returned to you at your cost, or refunded at a reduced amount at our discretion.

7.7 Damaged or defective rugs

If your rug arrives damaged, defective, or significantly different from its description, contact us within 14 days of delivery with photos. We will arrange free return shipping and either replace the rug, repair it, or refund you in full at your choice.

8. Custom Orders (Commissions)

We accept custom commissions for bespoke rugs in any size, motif, and knot density.

8.1 Process

  1. Submit your specifications through our Custom Order page;
  2. We confirm feasibility, lead time, and price in writing;
  3. You pay a 50% deposit to start work;
  4. We provide updates and photos throughout the weaving process;
  5. Final balance is due before shipping.

8.2 Lead times

Custom rugs typically take 4 to 8 weeks from deposit to shipping, depending on size, knot density, and the cooperative’s workload.

8.3 Cancellation

  • Before weaving begins (typically 2 to 6 weeks after deposit), you may cancel for a 90% refund of your deposit;
  • Once weaving has started, the deposit is non-refundable;
  • Once the rug is complete, the order is non-cancellable.

8.4 Quality guarantee for custom rugs

Custom rugs are non-returnable for change of mind, but if there is a workmanship defect or a significant deviation from the agreed specifications, we will rework, replace, or refund at our discretion.

9. Intellectual Property

9.1 Site content

All content on the Site — including text, images, photographs, logos, design, layout, software, and product photos — is owned by House of Berber or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works from any Site content without our prior written permission, except for personal, non-commercial use (e.g., saving a product image for personal reference).

9.2 Berber motifs

Traditional Berber motifs are part of the cultural heritage of the Atlas tribes. We document and photograph them respectfully and do not claim ownership over the traditional designs themselves. We do claim ownership of our specific product photography and creative compositions.

9.3 Reviews and user content

If you submit reviews, photos, or other content, you grant us a worldwide, royalty-free, non-exclusive licence to use, reproduce, modify, and display this content for the purpose of operating and promoting the Site. You retain ownership of your content.

You confirm that any content you submit:

  • Is original or you have rights to share it;
  • Does not infringe any third party’s rights;
  • Is truthful, lawful, and non-defamatory.

10. Acceptable Use

When using our Site, you agree NOT to:

  • Use the Site for any unlawful purpose or to violate any law;
  • Attempt to gain unauthorised access to any part of the Site, our systems, or another user’s account;
  • Use automated scraping tools, bots, or harvesters without our written consent;
  • Reverse-engineer, decompile, or attempt to extract source code from the Site;
  • Submit false, misleading, or fraudulent information;
  • Use the Site to transmit malware, viruses, or harmful code;
  • Harass, abuse, or threaten our staff or other users;
  • Resell our products as new without our written authorisation.

We reserve the right to suspend or terminate access for users who violate these rules, and to pursue legal remedies where appropriate.

11. Disclaimers and Limitation of Liability

11.1 Site availability

We strive to keep the Site available and free of errors but do not guarantee uninterrupted access. We may suspend the Site for maintenance, updates, or for any other reason without notice.

11.2 Warranties

To the maximum extent permitted by law, the Site and its content are provided “as is” and “as available.” We make no warranties — express, implied, statutory, or otherwise — regarding the Site’s availability, accuracy, completeness, or fitness for a particular purpose, beyond the specific warranties stated in these Terms (authenticity guarantee, return policy, etc.).

Statutory consumer rights: Nothing in these Terms limits or excludes any non-waivable statutory rights you may have as a consumer (such as those under EU consumer law, the UK Consumer Rights Act 2015, or similar laws in your jurisdiction).

11.3 Limitation of liability

To the maximum extent permitted by law:

  • Our total liability under or in connection with these Terms or your order is limited to the total amount you paid for the product giving rise to the claim;
  • We are not liable for indirect, consequential, incidental, special, or punitive damages (including lost profits, lost opportunities, or data loss);
  • We are not liable for delays or failures caused by events outside our reasonable control (force majeure), including but not limited to natural disasters, war, pandemic, customs holds, courier strikes, or government restrictions.

Nothing in this Section limits liability for: death or personal injury caused by our negligence, fraud, or any other liability that cannot be lawfully limited.

12. Indemnification

You agree to indemnify and hold House of Berber, our staff, and our partner cooperatives harmless from any claims, losses, damages, or expenses (including reasonable legal fees) arising from:

  • Your breach of these Terms;
  • Your violation of any law or third-party rights;
  • Your use of the Site or our products;
  • Content you submit to the Site.

13. Governing Law and Dispute Resolution

13.1 Governing law

These Terms are governed by the laws of the Kingdom of Morocco, without regard to its conflict of law principles. For consumers resident in the EU, EEA, or UK, you also benefit from the mandatory consumer protection provisions of your country of residence.

13.2 Informal resolution

Before initiating any formal legal action, we ask that you first contact us at [email protected] with a description of the issue. We commit to making reasonable efforts to resolve disputes amicably within 30 days.

13.3 Jurisdiction

Any unresolved dispute will be submitted to the competent courts of Marrakech, Morocco, except where mandatory consumer law in your country of residence grants you the right to bring proceedings in your local courts. EU and UK consumers retain the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

13.4 No class actions

To the extent permitted by law, you agree to resolve disputes with us on an individual basis only, not as a plaintiff or class member in any class, consolidated, or representative action.

14. Privacy

Your privacy matters to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you also agree to the Privacy Policy.

15. Force Majeure

We are not liable for any failure or delay in performance due to events outside our reasonable control, including but not limited to:

  • Natural disasters (earthquakes, floods, fires);
  • Pandemics or public health emergencies;
  • War, terrorism, or civil unrest;
  • Government actions, sanctions, or import/export restrictions;
  • Courier strikes or transport disruptions;
  • Power, internet, or telecommunications failures;
  • Acts of weavers’ associations or cooperatives.

During such events, we will make reasonable efforts to communicate with affected customers and propose alternatives (delayed delivery, full refund, store credit).

16. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, legal requirements, or for other operational reasons.

The “Last updated” date at the top of this page indicates the most recent revision. We encourage you to review these Terms periodically.

For material changes that affect your existing rights, we will notify registered customers by email at least 30 days before the changes take effect. Continued use of the Site after the changes take effect constitutes acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be severed from these Terms, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any order confirmation, constitute the entire agreement between you and House of Berber regarding your use of the Site and any purchase, superseding any prior agreements or communications.

19. No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative.

20. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms to a successor entity (e.g., in case of merger or acquisition) without your consent.
